              June’s Best Facebook Group Photos

              Week after week, month after month I am continually blown away by the talent pool found in our Fstoppers Facebook Group. What is more stunning is the level of improvement seen from members. I have watched those who went from boring, amateur, flawed images in January improve to jaw dropping, heart stopping dramatic masterpieces of posing and light in June. This past month has seen a slough of outstanding images, each truly great on their own merit.

                Wow.  Thank you for featuring my long exposure photo of the pier.  I posted it to see if anyone could guess where it was, because I got such great comments on my first shot which was of a different pier.  I guess I need to share more.  I don’t think anyone knew the location. :)

                I hate to say this but De’Jon Howerton’s photo isn’t actually his. The BMW and background was shot by JJ Batte, an LA based photographer.                 How much do I have to change in order to claim copyright in someone else’s work? Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work. Accordingly, you cannot claim copyright to another’s work, no matter how much you change it, unless you have the owner’s consent. See Circular 14, Copyright Registration for Derivative Works.

                UPDATE: De’Jon purchased the image from a stock photography site. He did not steal it. That said, he is not in the wrong. If JJ Batte did not register his image for resale, he needs to take that up with the stock photography company, which he has been made aware of.

                Hey De’jon why don’t you be a nice guy and upstanding artist and provide said license.  If not you’ll go down as a fraud.  The photographic community is pretty tight and you’ll go down as a fraud and and a thief if you can’t provide proof.

                Why would you feature a photo that is using someone else’s background image?  Doesn’t that defeat the whole purpose of this showcase?  

                Title blurb should read:”I have watched those who went from boring, amateur, flawed images in January improve to dropped in graphics on top of jaw dropping, heart stopping dramatic masterpieces of posing and light in June” 

                By leaving that submission up you’re basically telling the photographic community that it’s ok to submit other’s work as your own.  Did he expressly state he used another person’s material in the background?  Even if he purchased it through a stock photo site, most of them still require credit to be given.  And even if not expressly stated in the purchase contract, a professional would know better and have the professional courtesy to give credit where it is due.  I vote remove all together.  I doubt any of those other photos are using another person’s copyrighted work as a background.  If they are, please correct me.

                I’m going to steal photos from now on and just hide behind a fake stock photography license that I will never be able to provide because I’m a liar and a thief. J.J. Batte has said he has never licensed this image to any company for stock photography use. So the fact remains it’s still stolen.  LOL @ Fstoppers siding with De’Jon Howerton. Such a joke!

                Pardon me for giving the benefit of the doubt. I never heard from the actual artist, so the complaints I was getting were all third party. 

                That said, some of you are right. So until I can verify the story, the image has been taken down.

                1. I didn’t steal ANYTHING! I PURCHASED that Red BMW pic on a stock site. 2. I don’t like how all of you ADULTS , without any certainty jump on me when not know any of the story. I wasn’t contacted and asked anything I was accused of stealing and INSTANTLY without any questioning I’m a thief. The picture was purchased LITERALLY 2 YEARS AGO from a stock site. The person who put it up there is the thief not me. I just brought it and decided to use it this year. I don’t like people shitting on my name I work very hard on building it up. Fstoppers again I appreciate everything and for the photographer I apologize for any misunderstanding. Again I STOLE NOTHING!

                Thank you for all the support, guys. I emailed De’Jon the day of this feature, and have yet to hear back from him with which stock photography site he purchased my image. I shot the original picture back in December of 2009 for MFEST and RD Sport and still own the rights to the image; the aforementioned parties were able to use the images for promotional material, but did not own the rights. I never released any of the images from the set to a stock photography site, so I am very curious to hear which site it was that sold De’Jon the picture.

                Ok fair enough. Now which stock site did you purchase it from? You deny any wrong doing yet cant supply the stock photography site. Everyone has asked you repeatedly for this information and yet you never answer. Sounds very sketchy on your part.

                you’re absolutely right… reason why I haven’t answered is because I HONESTLY DON’T KNOW… as I told J.J. I’m trying to track it… the only thing I have is a folder on my computer that says “HI DEF”and inside that folder it says “Paid Stock”…  I checked my main sites which are Istock, Stockxchange it’s not from neither… I honestly don’t know… and at best what I can do and have been trying to do since I’ve been getting smashed is trying to clear my name. Again… I do photography, retouching and photomanipulation for a living. I have ABSOLUTELY NO NEED TO STEAL…
