I think this is a neat concept. I would have gone with a three if the man's face wasn't out of focus. It seems to be focused on his leg. Image does have a ton of feeling to it.
This is art... powerful in the rendering. The focus is perfect. The eye sees what it will. This is a beautiful photograph!
